Request Your California Employment Records

Prepare separate personnel and payroll records requests, understand their scope, and preserve delivery evidence before discussing a workplace dispute.

THE DIRECT ANSWER

California personnel files, payroll records and documents you signed at work involve different access rules. A focused request identifies the correct category, date range and delivery method. Keep proof of the request and review any statutory exceptions before assuming every company document must be produced.

Personnel records and payroll records are different

Personnel records can include material relating to performance or grievances. Payroll records document pay and hours. Labor Code section 1198.5 and section 226 address different requests; section 432 concerns copies of documents signed to obtain or hold employment.

A personnel request is generally made in writing and ordinarily carries a thirty-calendar-day response period, subject to applicable exceptions and permitted extensions. Payroll access or copies generally must be provided as soon as practicable and no later than twenty-one calendar days after a covered request. Check current agency guidance and your particular situation.

A personnel request you can adapt

Example: I request inspection and a copy of personnel records relating to my performance or any grievance concerning me under Labor Code section 1198.5. Please confirm receipt and explain how you will provide access or copies.

Add your name, employment dates, a safe response address and the date sent. This example is general information; an attorney may narrow or change a request for an existing lawsuit, a union agreement or another exception.

A separate payroll request you can adapt

Example: I request inspection and copies of my payroll records for the following period under Labor Code section 226. Please include the records showing my hours, rates, gross wages, deductions and pay periods.

Use a defined period and keep the payroll request distinct from an open-ended request for every document about the company. Keep the sent message, delivery confirmation, responses and production together.

What if the production is incomplete?

Make an inventory of what arrived and what appears missing. A missing document, a claimed exception and a refusal to provide access can raise different issues. Do not assume a late response proves the underlying employment claim.

An attorney can review the request, applicable response period, claimed exceptions and potential remedies. A records request does not file a wage or discrimination claim and does not automatically extend any filing deadline.

Must I use a company form?

The applicable rule controls the request. Keep a clear record of what you asked for and seek advice if a form appears to limit your rights.
